Mock Trial in Medical Malpractice
The Medical Malpractice Mock Trial is a superb method for educating physicians and nurses about the legal system and prepare them to confront trial proceedings with more objectivity and less fear of the judicial process.
Mock trials are staged in Law schools to teach Law students and Attorneys about trial procedure and technique. Mock trials are also effective methods of educating physicians about medical malpractice lawsuits. This medical malpractice trial comprises:
1. A Trial Judge;
2. Plaintiff and defense medical malpractice attorneys;
3. Case presentation;
4. Examination of expert medical witnesses for both sides; and
5. A jury.
The mock trial presents to physician attendees different sides of the issue in a legal setting. Presenting both the medical evidence and the final outcome of the lawsuit points out how important the decisions doctors make are, and the ramifications they can have. Following the mock trial, the attendee physicians spend time talking about what they would have done differently during a panel session.
Objectives of the Mock Trial
1. Identify major professional liability risks presented in the mock trial case study.
2. Learn the correlating risk management practices and strategies for minimizing or avoiding those risks in everyday professional practice.
3. Learn the major components of a medical malpractice trial, including the concepts of standard of care and negligence.
4. Participate as the jury in deliberating about the verdict in an obstetrical case which involves injury to the newborn.
5. Learn what actions a defendant-physician can take during litigation to increase the chances of a successful outcome.
6. Become familiar with what acts or omissions of the defendant-physician a plaintiff attorney looks for in a case in order to demonstrate negligence and liability on the part of the defendant-physician.
7. Become familiar with what acts or omissions of the defendant-physician a defense attorney looks for in a case in order to defend against charges of negligence and liability on the part of the defendant-physician.
8. Understand the roles of the defense and plaintiff expert witnesses in medical malpractice litigation.
9. Understand the role of the judge in a medical malpractice trial. The mock trial benefits also include an improvement in writing more complete notes in the medical records, as some day those notes may be projected onto a courtroom big screen.
